Revmap - Terms of Use

Welcome to revmap, a social utility tool that lets you find and add local submissions, see what's popular according to user voting and see what your friends think about yours and others submissions. The revmap service and network (collectively, "revmap" or "the Service") are operated by Revmap Ltd. and its corporate affiliates (collectively, "us", "we" or "the Company"). By accessing or using our web site at www.revmap.com (the "Site"), you (the "User") signify that you have read, understand and agree to be bound by these Terms of Use ("Terms of Use" or "Agreement"), whether or not you are a registered member of revmap.

Changing these terms

We reserve the right, at our discretion, to change, modify, add, or remove terms at any time without notice and, unless otherwise indicated, such changes will become effective immediately; therefore, please check these terms periodically for changes. By using revmap after the posting of changes to this Agreement you are accepting any such changes. If you do not agree to abide by these or any future Terms of Use, do not use or access (or continue to use or access) the Service or the Site. It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use and to review such changes.

Your responsibilities

You understand that all text, music, information, data, sound, software, photographs, videos, graphics, messages or any other form of content, either displayed publicly or sent privately, are the sole responsibility of the person from whom the content originated. We do not control content posted via revmap and does not guarantee or in any way endorse the truthfulness, quality or taste of such content. You understand that by using revmap, you might be exposed to content that is offensive, indecent or objectionable. If your content is found or reported to be in violation with, but not limited to, the following terms, we reserve the right to remove and permanently delete the content.

You agree not to :

• Use the service for any content which can be considered threatening, abusive, harassing, defamatory, libelous, vulgar, obscene, or racially, sexually or ethnically or otherwise objectionable;
• Introduce into the Service any information or material which may be damaging to others;
• Use revmap as a forwarding service to another website or referrer site, or allow use of revmap for such actions by a third party;
• Post, upload or transmit any content that is in our opinion unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, hateful, or racially, ethnically or otherwise objectionable;
• Harm or intend to harm minors in any way, as may be determined by revmap in its sole and absolute discretion or under applicable law;
• Impersonate any person or entity, or falsely state or otherwise misrepresent yourself or your affiliation with any person or entity, including revmap;
• Alter, forge or manipulate identifiers in order to disguise the origin of anything transmitted via revmap;
• Post, upload or transmit any content that you do not have a right to disseminate or that infringes any patent, trademark, trade secret, copyright or other proprietary rights of someone else;
• upload, post, transmit, share or otherwise make available any unsolicited or unauthorized advertising, solicitations, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
• Post, upload or transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
• Tamper with revmap or servers or networks connected to revmap, or fail to follow any and all requirements, procedures or regulations of networks connected to revmap;
• Intentionally or unintentionally violate any applicable local, national or international law;
• upload, post, transmit, share, store or otherwise make available content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
• Promote or provide guidance about illegal activities, such as providing instructions on how to assemble bombs, grenades and other weapons or incendiary devices;
• Promote physical harm or injury against any individual or group, or promote acts of cruelty to animals;
• "Stalk" or otherwise harass another person or company;
• Collect, store or use personal data about other users for business or commercially-motivated purposes;
• use the revmap service in any unlawful manner or in any other manner that could damage, disable, overburden or impair the revmap service;
• Allow the use of revmap by third parties in violation of this Agreement;
• solicit personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes.
• use or attempt to use another's account, service or system without authorization from revmap, or create a false identity on the revmap service.
• upload, post, transmit, share, store or otherwise make available content that, in the sole judgment of revmap, is objectionable or which restricts or inhibits any other person from using or enjoying the revmap service, or which may expose revmap or its Users to any harm or liability of any type.
• We reserve the right to review the content, public or otherwise, of all revmap web-pages to make sure that you comply with this Agreement. In the event of any violation of this Agreement, we may, at our sole discretion, delete any content posted to revmap or terminate your account at any time without any warning.

Third Party Content

The Site contains (or you may be sent through the Site or the Services) links to other web sites ("Third Party Sites") as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, software and other content belonging to or originating from third parties (the "Third Party Content"). Such Third Party Sites and Third Party Content are not investigated, monitored or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third Party Sites accessed through the Site or any Third Party Content posted on the Site, including without limitation the content, accuracy, offensiveness, opinions, reliability or policies of or contained in the Third Party Sites or the Third Party Content. Inclusion of or linking to any Third Party Site or any Third Party Content does not imply approval or endorsement thereof by us. If you decide to leave the Site and access the Third Party Sites, you do so at your own risk and you should be aware that our terms and policies no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any site to which you navigate from the Site.

Security

All members of revmap have a username and password. You are entirely responsible for maintaining the confidentiality of these details. You are entirely responsible for any and all activities which occur on your account. You may change your password at any time using your online account; you can also close your account at any time by contacting us. If you believe that someone may be using your account to access information held privately in your account without your consent, you must contact us immediately.

Availability

The Company uses reasonable endeavours to ensure that the Service is available 24 hours a day, 7 days a week. However, there will be occasions when the service will be interrupted for maintenance, upgrades and emergency repairs or due to failure of telecommunications links and equipment that are beyond the control of us. Every reasonable step will be taken by us to minimise such disruption where it is within the reasonable control of the Company.

Intellectual Property

As a user you retain any rights to the content that you publish on revmap that you already own. You also acknowledge that (i) revmap permits access to content that is protected by copyrights, trademarks and other intellectual and proprietary rights ("Rights"); (ii) these Rights are valid and protected in all media and technologies existing now or later developed; and (iii) except as explicitly provided otherwise, these Terms and Conditions and applicable copyright, trademark and other laws govern your use of such Rights. You may not post to revmap, copy, reproduce, retransmit, distribute, publish, commercially exploit or otherwise transfer any material subject to any Rights. The burden of determining that any information, software, images or any other content on revmap is not protected by Rights rests with you. You acknowledge that you will not acquire any Rights by downloading any materials from revmap.

Copyright Infringement

If you believe that content you own has been used on revmap in a way that violates your copyright or other intellectual property rights, please provide our customer service team with the following information:

• an electronic or physical signature of the person authorised to act on behalf of the owner of the copyright or other intellectual property interest;
• a description of the copyrighted work or other intellectual property that you claim has been infringed;
• a description of where the material that you claim is infringing is located on the site
• your address, telephone number, and email address;
• a statement by you (made under penalty of perjury) that you have a good faith belief that the disputed use is not authorised and that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorised to act on the copyright or intellectual property owner's behalf and have proof of such authorisation and title to such rights.
• You can make an initial contact at legal@revmap.com and we will deal with your claim and provide any further information that may be required.

Content

The content you create is yours, and you retain all ownership rights to content you publish on. User Content means content (on our website posted by users of it (but not the structure and content of it that we create to enable you to use it)) of any type or medium, including but not limited to letters, emails or other messages, other forms of communication through our website, personal user information, board posts, comments, blogs, data, images, audio or video files and guides. You represent, warrant and agree that no materials of any kind submitted through your account or otherwise posted or shared by you through the Service will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material. You further agree not to harvest or collect email addresses or other contact information of Users from the Service or the Site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications. You agree that we do not endorse any User Content and are not responsible or liable for any User Content and that you indemnify us against all costs, claims and liabilities that we may incur to third parties arising from your breach of these Terms of Use.

By using our website you grant us a non-exclusive, royalty-free, irrevocable, perpetual, and assignable right to use, reproduce, adapt, modify, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media. You also grant us and our sub-licensees the right to use the name that you submit in connection with such User Content, if they choose but also to publish your User Content without accreditation

We reserve the right to refuse, edit, move or remove any User Content from our website with or without justification at any time.

If User Content includes information on venues or events including opening times, accessibility or availability of tickets, you are advised to check with the relevant venue or organisation before setting out or incurring any expense.

Termination

We reserves the right, at our sole discretion to immediately and without notice to you to restrict, suspend or terminate (i) these Terms of Use; (ii) your registration with or ability to access revmap and/or any other service provided to you by us upon any breach, or suspected breach by you of the Terms of Use (as determined in our sole discretion). The restriction, suspension or termination of revmap pursuant to this section will be without prejudice to any rights which we may have against you in respect of your breach of these Terms of Use. revmap and its licensees may continue or stop publicly displaying some or all of your User Content

Disclaimer of Warranties

Revmap is provided on an "as is" and "as available" basis. We expressly disclaims all warranties or representations of any kind, express or implied, to the fullest extent permitted by law.

You understand and agree that the Company does not guarantee the accuracy or completeness of any information in or provided in connection with revmap. We are not responsible for any errors or omissions or for the results obtained from the use of such information. The information is provided with the understanding that neither the Company, its employees or consultants or its members, while such members are participating in revmap, are engaged in rendering legal, medical, counseling or other professional services or advice. The Company encourages you to seek appropriate professional advice or care for any situation or problem which you may have.

We shall not be responsible for any loss or damage caused, or alleged to have been caused, directly or indirectly, by the information or ideas contained, suggested or referenced on revmap. Your use and membership of revmap is solely at your own risk. No advice or information, whether oral or written, obtained by you from revmap or through revmap shall create any warranty not expressly made in these Terms of Use or imposed by law.

Limitation of Liability

To the fullest extent permitted by law the Company shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use revmap, or resulting from unauthorised access to or alteration of your transmissions or data even if the Company has been advised of the possibility of such damages.

We do not guarantee that data (including but not limited to images, videos, text, files or contact information) stored by revmap users will be recoverable.

Remedies for Breach of these Terms by You

In the event that the Company determines, at its sole discretion, that you have breached any portion of these Terms of Use, or have otherwise demonstrated conduct inappropriate to revmap, the Company reserves the right to (i) warn you via e-mail that you have violated these Terms of Use; (ii) delete any content provided by you or your agent(s) to revmap, (iii) discontinue your account with revmap (iv) notify and/or send content to and/or fully cooperate with the proper law enforcement authorities and/or agencies for further action; and/or (v) take any other action which we deem to be appropriate.

Community Monitoring and Responsibilities

Monitoring. We do not actively moderate User Content but we reserve the right to monitor and remove content which, in our absolute discretion, constitutes a misuse of these Terms of Use.

We do not control or endorse the content, messages or information found on our website and, therefore, we and our affiliates specifically disclaim any liability with regard to User Content and any actions resulting from your participation or the participation of others using revmap.

Indemnity

You agree to indemnify and hold the Company, its subsidiaries and affiliates, and each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorney's fees, arising out of or in connection with any User Content, any Third Party Content you post or share on or through the Site, your use of the Service or the Site, your conduct in connection with the Service or the Site or with other Users of the Service or the Site, or any violation of this Agreement or of any law or the rights of any third party.

Non-Waiver of Rights

Our failure to act in a particular circumstance does not waive our right to act with respect to that or other circumstances. We shall be excused for any problem due to a factor beyond our control.

User Disputes

You are solely responsible for your interactions with other revmap users. We reserve the right, but have no obligation, to monitor disputes between you and other users.

Applicable Law

These Terms of Service shall be governed by and construed in accordance with the laws of England.
